Directive (EU) 2024/1275 of the European Parliament and of the Council of 24 April 2024 on the energy performance of buildings (recast) (OJ L of 8/5/2024) was published in the Official Journal of the EU on 8 May 2024. Regulations the directive entered into force on May 28, 2024. All member states will have, depending on the provisions of the directive, to implement it no later than May 29, 2026.

Recently, we have been observing increased media activity related to the transmission of false information, including: on the obligatory modernization of buildings in Poland or the ban on the use of selected heat sources in buildings. Sensational media titles and the use of sentences taken out of context unfortunately cause information confusion – emphasize representatives of KRiR.

So what is behind the EPBD directive, according to the Ministry of Environmental Protection?

Requirements for the energy performance of buildings have been increased for 15 years

Minimum requirements for energy performance have been successively increased since 2009. This is due to progress in construction, installation and energy production technology, growing user requirements and a policy aimed at rational use of energy.

After the entry into force of the new EPBD, the applicable provisions of the regulation on the technical conditions to be met by buildings and their location will be subject to review and corrections.

When will new buildings have to be emission-free?

The requirements will be set at the optimal level in terms of costs and so that from January 1, 2028, new buildings owned by public institutions will be emission-free and from January 1, 2030, all other new buildings will be emission-free.

A zero-emission building means a building that has very high energy performance, requires zero or very little energy, produces no on-site carbon dioxide emissions from fossil fuels, and produces zero or very low operational greenhouse gas emissions.

Will owners of agricultural buildings and houses be forced to renovate and replace boilers?

According to KRiR, the current legal system and the provisions of the above-mentioned Directive do not force private owners to renovate houses/agricultural buildings/apartments, nor do they directly prohibit the use of selected heat sources in buildings. First of all, the objectives of the directive are imposed on the Member State and not directly on citizens.

Member States have a whole range of possibilities to achieve the goals – primarily through financial incentives for renovations. The Ministry of Development and Technology is working on the assumptions for the implementation of the directive and does not provide for mandatory renovations of existing buildings or mandatory replacement of gas boilers – emphasize KRiR experts

The modernization of buildings will involve a system of incentives for modernization, and not an authoritarian order to modernize buildings, especially those whose modernization has no logical justification. Moreover, there are no plans to impose penalties for failure to carry out illogical, unprofitable modernizations.

Does the EPBD directive not directly force the replacement of gas boilers?

As KRiR experts emphasize, the EPBD directive does not directly force the replacement of gas boilers. However, from 2040, will it not be possible to heat houses and buildings with natural gas, eco-pea coal, coal or fuel oil?

It contains a provision that the Member State is to present a plan to phase out fossil fuel boilers by 2040. However, accountability will be based on the presentation of the plan and the efforts made to achieve it, and not on the achievement of the goal. Owners of gas boilers will therefore be able to continue to use them after 2040, say KRiR experts. – The provisions of the directive include a ban on subsidies (incentives, aid programs, etc.) for the installation of fossil fuel heating devices from 2025 (with certain exceptions)
