The application filed by Vladislav Bakalchuk to Rospatent on August 7, 2024, addressed to the head of the department, Yuri Zubov, emphasizes that the transfer of trademarks from Wildberries to the structure formed by the parties to the transaction may violate his rights and the rights of his wife, Tatyana Bakalchuk, as co-owners of the Internet company. The appeal to the department may be a preliminary step for the imposition of interim measures that will temporarily prohibit the transfer of rights to the marks to a third party.
Bakalchuk's appeal reports on 29 objects of intellectual property, including the main domain of the wildberries.ru marketplace, as well as the rights to a program for automating the work of couriers.
Despite the fact that entrepreneurs often contact Rospatent with such applications, the agency does not have regulations for considering such applications.
In Wildberries LLC, 1% belongs to Vladislav Bakalchuk, 99% to his wife Tatyana. In June 2024, Wildberries announced a merger with Russ Group. In July, the parties created a joint venture RVB, where 65% went to Wildberries LLC and 35% to Stinn LLC, the beneficiaries of which are the brothers Levan and Robert Mirzoyan, owners of Russ Group.
