In mid-June, the management board of KRiR, supporting the application of the Wielkopolska Chamber of Agriculture, turned to the president of ARiMR regarding the regulation of inspections by external entities based on current data from the e-application system.

This is the result of the situation that took place in the Jarocin district. In the fall of 2023, external companies commissioned by the Agency carried out field inspections there in terms of compliance with the principles of conditionality and the implementation of surface ecoschemes. But they worked there based on data transferred from ARiMR systems in August 2023.

Farmers make modifications

Meanwhile – as KRIR notes – some farmers made changes to ecoschemes after this date. As a result of the introduced modifications, the markings of individual agricultural plots changed, about which the inspecting entity was not informed by the ordering administrative authority, which resulted in the inspection being carried out on outdated data. An attempt to update the post-inspection report by submitting an appeal was met with a negative decision of the ARiMR OR due to, as it was informed, the contractor was not obliged to carry out the inspection on the changed data even though the visit took place after the deadline for changing the application.

In the opinion of the agricultural self-government, field inspections performed by external entities should be carried out on the basis of current data generated a maximum of several days before the planned inspection, as is the case with inspections carried out by veterinary inspectorates, where control data are generated a day before the field visit .

ARiMR explains why it is not that simple

The information posted on the ARiMR website regarding the deadlines for submitting a payment application with the required attachments in 2023 and 2024 clearly shows that if certain conditions are met both in 2023 and in 2024, the farmer had and still has the opportunity to both submit changes to the application as well as total or partial withdrawal of the application until the date of issuance of the decision on the granting of payment.

The content of these entries is as follows:

"The farmer, by the date of issuance of the decision on granting the payment, may inform the head of the Agency's district office about all changes in the information contained in the application for granting these payments – these changes may not result in an increase in the area declared for payment.

The farmer may, on his own initiative, completely or partially withdraw the application for payment, no later than the date of issuance of the decision on granting payment, however, withdrawal is not possible if:

  • concerns the part of the application in which irregularities were detected;
  • the applicant has been informed of the intention to carry out an on-site inspection.

It is clear from the above-mentioned provisions that there is no convenient date for carrying out an on-site inspection to take into account all potential changes made by the farmer regarding the information contained in the application due to the possibility of reporting them until the date of issuance of the decision – he emphasizes in response to KRIR Stanisław Sas, Director of the Department of Reference Bases and Field Inspections of ARiMR.

As he adds, the contracts concluded by ARiMR with inspection contractors oblige ARiMR to release data for inspection within specified deadlines, which involves issuing data for inspection in the state in which they are in the ARiMR IT system on a given day after achieving the appropriate status of completeness. Therefore, among others the first page of the direct payments control report includes information on the date of data export for the purposes of this control. If the farmer reported changes to the application close to the above-mentioned date of data export or after this date, it is possible that they were not taken into account in the control process.

– Nevertheless , the task of the on-site inspection is to verify the actual state of affairs in the field, and even if changes to the application have been reported in the meantime, the inspection will still document the actual state of affairs. However, any reported changes may be considered and possibly taken into account in the process of handling the application and issuing decisions by employees of ARiMR District Offices – explains the director.
