The Wielkopolska Chamber of Agriculture asked the Ministry of Agriculture of the Wielkopolska Chamber of Agriculture with a question regarding the situation in which a farmer wants to transfer the farm to a successor and has previously benefited from support for replacing roof coverings made of materials harmful to health or the environment on farms from the National Reconstruction and Resilience Plan (KPO).

However, the ministry provided reassuring explanations in response.

– § 13 of the agreement to cover the project with non-repayable support from the development plan contains provisions regarding the possibility of transferring ownership of the real estate on which the roof replacement project is being implemented or has been implemented. In paragraph 1 specifies that if the support granted has not been paid in full, the Agency for Restructuring and Modernization of Agriculture may, under certain conditions, grant it to the legal successor of the final recipient of the support or the purchaser of real estate. In paragraph 9, however, specifies the possibility of transferring the ownership of the real estate on which the project was implemented after payment of the entire support – wrote the Ministry of Agriculture and Rural Development.

The Ministry of Agriculture further details:

– In such a situation, i.e. when the roof covering on a building used for agricultural production was replaced and the support was paid in full, in accordance with § 13 section 10, the final recipient of support notifies the Agency of the intention to transfer the ownership of the real estate on which the project was implemented, along with justification and necessary documents, before the planned change. The procedure in the above-mentioned cases is described in detail in § 13 of the concluded contract.

Referring to § 4 point 13 of the agreement, which states that the property rights for which the support from the Ministry of Agriculture and Rural Development was paid, he explains that this provision contains a reservation regarding § 13 discussed above. This reservation means that § 4 point 13 of the agreement does not apply to the situation specified in § 13 of this agreement (they concern a situation in which the farmer fails to complete the formalities and wants to transfer the property while the support is being paid).

The ministry also informs that farmers can obtain additional information on how to proceed directly from the Agency for Restructuring and Modernization of Agriculture, with which they concluded a contract for the implementation of the project.
