The Animal Health Act is getting closer. Does it pose a threat to breeders?

ZPM representatives focused on two provisions. The first of them concerns reducing the use of antibiotics in animal production by 50%, while the second concerns tightening penalties for the unauthorized use of banned or unauthorized substances and medicinal products.

"In Art. 54 section Article 5 of the draft Act introduces provisions that implement the obligations arising from the European Green Deal and the Farm to Fork Strategy, which indicate as a goal to be achieved by 2030 a 50% reduction in the use of antimicrobials for animals kept on farms and in the field of aquaculture, and the fact that Poland as one of the leaders in the sale of veterinary medicinal products indicates the need to undertake and coordinate actions on many levels.

"In Art. 25 of the IPP Act, it is proposed to increase penalties for non-compliance with specific requirements related to the use of prohibited or unauthorized substances referred to in Art. 16 section 1 and medicinal products, the penalty of restriction of liberty or imprisonment of up to 3 years is proposed, instead of up to one year. It has been proven that residues of some substances having thyrostatic, estrogenic, androgenic and gestagenic effects may accumulate in meat and other foods of animal origin and be dangerous for consumers and reduce the quality of these foods. above substances with hormonal effects regulate such important activities as growth and sexual maturation and influence the proper development and balance of the body. Therefore, even the smallest amounts, e.g. consumed with food, can have a very strong impact on the human body and disturb the proper functioning of these functions.

Additionally, the draft act includes a catalog of acts punishable by a financial penalty imposed by a veterinarian by way of an administrative decision. The amount of penalties is to be related to the amount of average monthly salary announced by the president of the Central Statistical Office.

“It is proposed that fines be imposed by way of an administrative decision, because the acts specified in these articles may be committed by natural persons and entrepreneurs who are not natural persons. This solution was already partially used in the Act of March 11, 2004. (…) The experience gained over several years since the introduction of the above solution shows that a financial penalty is a more effective and faster tool for enforcing applicable regulations," we read.

From the breeder's perspective

The Polish Meat Association also quoted Bartosz Czarniak, a pig breeder and spokesman for PZHiPTCh Polsus:

The project is a very extensive document that requires careful analysis. No one denies the need to standardize and organize regulations. However, at first glance we see some threats. As for the proposed 50% reduction in antibiotics used in breeding, it is not known who and on what basis will establish the base that will be the basis for setting the original ceiling. I'm afraid that at the moment no one really knows exactly how many drugs are used in Polish farms. It would be worth introducing an electronic animal treatment book earlier, which should be operational for some time. Only on this basis and after collecting reliable data will it be possible to talk about the need to reduce the number of drugs, or the lack thereof, and about the scale. Another point requiring more detailed analysis are issues that allow veterinarians to punish breeders by way of an administrative decision. Of course, the best situation is one where the doctor is a partner of the breeder and provides him with his knowledge and support. Unfortunately, you can also imagine situations in which, for one reason or another, a veterinarian will use these powers too often. I don't think anyone needs to be explained what the effects of this will be. In an oppressive system, few people want to run a business. The liquidation of subsequent farms means not only a reduction in livestock production, but also a loss of recipients for grain produced by Polish farmers, because breeders are the main recipient of Polish grain. I don't think anyone needs to be explained what consequences this will have for the Polish economy. I am also surprised by the increased penalties of restriction and deprivation of liberty provided for in the bill. I do not think that increasing penalties will improve animal welfare. Our breeders are perfectly aware that the well-being of their animals is in their well-understood interest, comments Czarniak.
