People under 18 years of age cannot buy an e-cigarette in Poland. There is a bill

The authors explain that changing the "Tobacco Act" is necessary due to the urgent need to limit the use of electronic cigarettes by young people. These products pose a clear threat to public health, in particular to the young generation and non-smokers, which necessitates the introduction of a ban on the sale of all types of electronic cigarettes and refill containers to persons under 18 years of age, regardless of whether a given product contains or does not contain nicotine composition.

New regulations on tobacco and tobacco products

In art. 2 of the Tobacco Act, containing a glossary of statutory terms, changes to individual definitions are proposed. First of all, the definition of "smoking electronic cigarettes" is changed (Article 2, point 17 of the Tobacco Act). The change will result in the use of electronic cigarettes with nicotine-free liquid being banned in public places where the use of electronic cigarettes with nicotine-containing liquid is currently prohibited.

However, the extension of the definition of "spare container" (Article 2, point 18 of the Act
tobacco) and "electronic cigarette" (Article 2(20) of the Tobacco Act) for products containing nicotine-free liquid will introduce a ban on the sale of such products to persons under 18 years of age, will introduce a ban on their sale in vending machines and a ban on distance sales, e.g. The Internet will also result in them being covered by a ban on advertising and promotion, similar to what is currently the case with electronic cigarettes with liquid containing nicotine and tobacco products.

There will be a warning on e-cigarettes

Moreover, it is proposed that a health warning: "Product harmful to health" be placed on collective packaging and individual spare containers as well as on nicotine-free electronic cigarettes.

According to the amendment, both nicotine-containing and nicotine-free liquids must be placed in specially designed containers with a maximum capacity of 10 ml, and in the case of disposable cartridges, the capacity cannot exceed 2 ml. Moreover, these liquids cannot contain the additives listed in Art. 7c section 3 of the Act, and the ingredients must be of the highest purity.

The legal framework for the electronic cigarettes market, defined by the Tobacco Act, is a consequence of the implementation into the national legal order of Directive 2014/40/EU of the European Parliament and of the Council of 3 April 2014.

The provisions of the directive regulate issues relating to the market for liquids for electronic cigarettes containing nicotine. However, the proposed regulations will cover the above-mentioned regulations also the so-called "nicotine-free liquids".

– The popularity of nicotine-free products increases the risk of young people accessing tobacco products to the same extent as electronic cigarettes with nicotine do. With this in mind, it is reasonable to limit the sale of nicotine-free liquids to persons under 18 years of age, as well as to ban their sale in vending machines or via the Internet – we read in the justification for the project.

The proposed regulation will affect the activities of micro, small and medium-sized enterprises.

– Due to the ban on distance sales introduced on its basis and the need to properly label the packaging of electronic cigarettes without nicotine, it is proposed that the act enters into force three months from the date of announcement – it was reported.
