According to NIK experts, during the period covered by the audit, the Regional Economic Fund exercised ownership supervision over the following companies:

  • Jurajski Agro Fresh Park SA,
  • Częstochowa Wiolinowa sp. z o. o.,
  • Hutmar SA
  • Amicus Medical Center Sp. z o. o

From November 16, 2020, the Fund and the National Center for Agricultural Support (KOWR) established a special purpose vehicle, Jurajski Agro Fresh Park SA, based in Kościelec.

The company's investments were to consist in the construction of four modern halls with an area of 10 thousand m2 each with operational and warehouse functions, as well as an administration and office building with accompanying infrastructure.

Agro Fresh Park with millions of losses

Three of the four companies included in the capital group of Fundusz Gospodarczy SA reported a net loss for 2020-2021.

Jurajski Agro Fresh Park SA for the financial year 2020/2021 showed a net loss of PLN 1,978,000. PLN, and for 2022 it showed a net profit of PLN 60.7 thousand. PLN, and it came mainly from interest received on a bank deposit and from the lease of agricultural real estate.

The activities of Jurajska Agro Fresh Park SA in the years 2020-2022, aimed at creating a unique, innovative agri-food market that is also a partner and base for regional food producers, were limited primarily to the preparation of current strategic documents of JAFP SA and planning the above-mentioned. investment. The update of the original assumptions on the basis of which the Company was to operate was due to the need to adapt its operations to the changed business conditions (including the COVID-19 pandemic and its effects). The request for quotation was published on March 1, 2023 – emphasize NIK experts. -It concerned the preparation and delivery of an architectural and construction design for an investment called "Construction of Jurajska Agro Fresh Park with accompanying infrastructure". In the inquiry, the deadline for signing the contract for the implementation of the main investment project was set for April 12, 2023. However, it was not met by the Company due to, among others, to the prolonged process of verification of submitted documents and bidders.

The second goal of the Company was to cooperate in the creation and participation in the development and activities of the National Food Group. This goal was ultimately abandoned, primarily due to a change in the concept of the above-mentioned activities. Group by its decision makers.

In the audited period, the operating costs of JAFP amounted to PLN 3,843.6 thousand, of which in the financial year 2022, remuneration accounted for 55.11% of the total operating costs of JAFP, NIK experts note.

During the inspection carried out at Jurajski Agro Fresh Park SA, the following irregularities were found:

  • The management board made a formal decision too late regarding the choice of the implementation variant of the main investment. As a result, there were delays in its construction. As a result, among others, there was no construction consent obtained until the inspection was completed.
  • On November 3, 2022, the company, i.e. almost two years after its establishment, commissioned the preparation of comprehensive tender documentation. During the audited period, the Company provided four times, via RFG SA, information on the current state of progress of the project to the Ministry of State Assets.
  • The Częstochowa Wiolinowa company was to build eight residential buildings with accompanying infrastructure with a total area of 26.4 thousand m2. m2. Some of the apartments are to be sold and some are to be rented. In 2020, the company generated almost PLN 403,000. PLN loss, for 2021 it showed a loss of almost PLN 1,160,000. PLN, and for 2022 a loss of just over PLN 806,000. zloty.

Hutmar with smaller losses, and Amicus in profit

HUTMAR SA company, whose main task was to trade eco-pea coal and conduct water and sewage management along with operating sewage treatment plants. The main direction of development was the construction of a photovoltaic farm. However, in 2020, the net loss was just over PLN 603,000. PLN, in 2021 the loss amounted to approx. PLN 548 thousand. PLN, and in 2022 approx. 150 thousand. zloty.

Only one company, i.e. Centrum Medyczne "AMICUS" Sp. z o. o. achieved a positive net financial result in the years 2020-2022. However, the Company's profits were relatively minimal and amounted to: PLN 11.7 thousand. PLN 62.8 thousand PLN 31.3 thousand zloty.

The Supreme Audit Office also detected irregularities in the RFG

Irregularities also occurred in the case of the Regional Economic Fund SA. The adoption of the Strategy for 2021-2025 by the Management Board of the Regional Economic Fund SA took place only in November 2021, even though the previous multi-annual strategy was valid until 2020. The bidding procedure for the new study started in January 2021 .

The delay in adopting the Company's Strategy resulted, among others, from: due to the postponement of the deadline for its submission from July 31, 2021 to September 30, 2021, as well as in connection with the comments submitted by the Fund's Supervisory Board to this document. Importantly, the Council did not adopt a resolution on the Strategy for 2021-2025. On May 4, 2022, the Company's Management Board signed an agreement to prepare a modified "Strategy of the Regional Economic Fund SA for 2021-2026". The original deadline for its preparation (June 30, 2022) was postponed several times. As a result of the above, the Management Board of the Fund did not adopt the company's strategy in an updated form – emphasize NIK experts.

The Management Board of the Fund, contrary to the content of the resolution on changing the scope of activity, did not extend the scope of its activities to include the provision of accounting and bookkeeping services, which it was obliged to do.

Due to the irregularities found during the audit, the Supreme Audit Office formulated the following post-audit conclusions:

  • Adoption by the Management Board and the Shareholders' Meeting of the modified Company Strategy for 2021-2026 and its implementation.
  • Implementation of the resolution of the Management Board of the Regional Economic Fund SA by extending the scope of activities to include accounting activities.
  • In connection with the activities of Jurajski Agro Fresh Park SA, supervised by the Regional Economic Fund SA, the Supreme Audit Office sent a notification on suspicion of committing a crime of mismanagement.
