The inspection covered both wholesalers and retail stores, including large-scale stores. Of the eight models inspected, five came from China, two from Poland and one from Germany. All mowers have been subjected to laboratory tests to assess parameters affecting their safe use.
Irregularities detected during the inspection
Inspectors found that out of eight mower models, three had serious irregularities. In two of these cases, more than one non-compliance was detected. It turned out that some models had incorrect instructions for use that were missing important information, such as conditions for safe transport and handling of the machine and the weight of the device. In one case, an incorrect declaration of conformity was found, and one model did not have markings regarding the nominal power directly on the device.
Laboratory results
Laboratory tests revealed serious design defects in three models – one electric mower and two combustion mowers. The electric mower posed a risk of electric shock and injury in the event of contact with rotating cutting elements, as access to a part insulated only with basic insulation was found and the permissible stopping time of the cutting element was exceeded.
The first petrol lawn mower did not pass the object ejection test for a mower working with a basket, which created a risk of injuring the user by objects escaping from under the working machine. The second petrol lawnmower had negative results in terms of foot contact with the cutting element at the rear of the mower, ejection of an object for a mower operating without a grass catcher, and exceeding the permissible stopping time of the cutting element, which could have led to serious injuries.
Consequences and corrective actions
In the case of one model, where only formal non-compliances were found, the entrepreneur quickly took corrective actions. However, in three cases where both formal and structural non-compliances were detected, administrative proceedings may be initiated, which may result in orders to withdraw the mowers from the market. In each of these cases, notices will be sent to law enforcement authorities to impose a fine for placing a dangerous product on the market.
Recommendations for entrepreneurs and consumers
The President of the Office of Competition and Consumer Protection and the Trade Inspection appeal to entrepreneurs to purchase products from reliable suppliers, carefully check the CE marking, verify declarations of conformity and attach correct instructions for use. Consumers are advised to make sure that the lawnmower they buy is accompanied by an operating manual in Polish and that the device has the CE mark. It is also important to properly prepare the area before starting work and remove any objects that may pose a threat during mowing.
