It is easy to become a speculator. Why did the farmer not receive a grain subsidy?

The farmer who called the farmer.pl editorial office sold his consumption wheat in March this year to the port (to Cargill). For which he of course has an invoice.

It so happened that in the following months he took over the farm from his parents with the breeding and it turned out that in May this year he had to buy a few tons of feed wheat for these animals.

The farmer, who asked to remain anonymous, so let’s assume his name is Paweł, obviously applied for a subsidy for the grain he sold – the one he sold in March.

However, the district office of ARiMR refused to calculate and pay him a subsidy for the grain sold – because it found out that he had bought feed wheat in May. It found out because the farmer who sold this feed wheat to Mr. Paweł also applied for a subsidy for the grain sold. And Mr. Paweł was "accused" of speculation.

And it was with this problem that Mr. Paweł called the editorial office of farmer.pl, because he did not understand why this happened.

What does ARiMR say about this?

We contacted the ARiMR headquarters with the question whether ARiMR actually has the right to refuse to pay the grain subsidy in the described situation, whether this is an overinterpretation and what the farmer can do to receive the subsidy for the consumption wheat sold in March.

Below is the answer:

– Dear Editor, the Agency for Restructuring and Modernisation of Agriculture makes every effort to process all applications for assistance as efficiently as possible. Agency employees carefully check the submitted documents necessary to receive support. Decisions are always issued based on applicable legal regulations. It is difficult for us to comment on a specific situation, because we do not have access to the documents. Therefore, our response is based on what results from the description of the case that you provided:

1. The farmer sold the wheat;
2. is the owner of a farm on which farm animals are kept;
3. purchased wheat for these animals.

According to the regulations , aid is not granted, among others, to an agricultural producer who is also an entity purchasing cereals in connection with the animal production conducted by this entity in relation to the sale of a given type of cereals that were purchased by this entity (section 2 § 13zzo of the Regulation of the Council of Ministers of 27 January 2015 – Journal of Laws item 187, as amended).

Dura lex, sed lex.

According to ARiMR data, so far the Agency has transferred over PLN 2 billion in grain subsidies to the accounts of 181 thousand farmers.

The budget earmarked for grain subsidies is PLN 2.1 billion. Over 187 thousand applications were submitted, and since the resulting amount exceeded the available limit, it was necessary to establish a correction coefficient – it is 0.92.
