How high should a Ukrainian employee's salary be? This question worries many employers. The answer is given by the leading legal consultant of the Labor Inspectorate, Vladimir Logachev, on Tööelu.ee. A citizen of Ukraine or a person who has received international protection in Ukraine and members of his family who resided in Ukraine before 24 February 2022 and left it on or after 24 February 2022 and do not have a valid Estonian visa or residence permit for temporary protection, have legal the right to stay and work in Estonia, even if other grounds for this have expired. This right also applies to citizens of Ukraine who were legally in Estonia before February 24, 2022. The employer must ensure that the foreigner meets the conditions for residence and work rights. The employer is obliged to pay remuneration for work, the amount of which is at least equal to the latest published by the Department of Statistics and multiplied by a factor of 0.8 of the annual average gross salary in Estonia in the field of activity in which the person begins work. When calculating the average gross salary, the letter code EMTAC of the classifier of economic activities in Estonia is taken as a basis. If a person has temporary protection, he has the right to work in Estonia under the same conditions as Estonian citizens. If a person gets a full-time job, he is entitled to a salary not lower than the minimum wage. From 1 January 2024, the minimum hourly wage rate is €4.86 and the minimum monthly wage rate is €820 (gross). If a foreigner works in Estonia on the basis of short-term employment registration, he must be paid a salary in accordance with the Aliens Act. In this case, the employer is obliged to pay the foreigner a salary in the amount of at least the average annual gross salary in Estonia. The average gross salary in Estonia is 1,832 euros per month.
