How close to the plot boundary can photovoltaics be built on the ground after changing building regulations?

The minimum distance of a photovoltaic installation mounted on the ground from the plot boundary is not directly regulated by law. The Regulation of the Minister of Infrastructure of April 12, 2002 on the technical conditions to be met by buildings and their location, which is most often used in resolving similar cases, does not regulate the location of structures such as photovoltaic installations built at the boundaries of plots.

The principle of installing photovoltaics on the ground at a minimum distance of 4 m from the plot border

There are no provisions in Polish legislation that would regulate the minimum distance of a home photovoltaic installation on the ground from the plot boundary. However, there is a rule that when placing a photovoltaic installation on the ground, it can be located at least 4 m from the plot boundary. This is, of course, to protect the investor against potential claims or protests from neighboring plot owners that may hinder the implementation of the investment.

Before installing photovoltaics on the land, it is worth checking the local spatial development plan (MPZP) in the commune and remembering neighborhood law.

The distance of the installation from the plot boundary may be specified in local development plans. You should also remember about the so-called neighborhood law, i.e. the provisions of the Civil Code that require the use of one's own property in accordance with the principles of social coexistence, as well as refraining from activities that would disturb the use of neighboring properties beyond the average level.
