
The draft law adapts Polish law to EU regulations on civil liability insurance for damage resulting from the use of motor vehicles. This also applies to enforcing the obligation to insure such liability.
Injured persons will be able to claim compensation from the civil liability insurance of motor vehicle owners in their place of residence or registered office, even if the insurer is insolvent. These tasks have been assigned to the Insurance Guarantee Fund.
The Polish Motor Insurers' Office will be responsible for paying compensation to persons injured as a result of events that occurred in the territory of another EU country or a third country, in the event of the insurer's insolvency.
The minimum guarantee amounts in civil liability insurance for motor vehicle owners and third party liability insurance for farmers will be increased. This applies to compensation payments by insurers. The new amounts will be:
- personal injury: PLN 29,876,400 in relation to one accident, regardless of the number of injured persons,
- property damage: PLN 6,021,600 in relation to one accident , regardless of the number of injured people.
A uniform form for certification of the history of claims under motor vehicle owners' civil liability insurance will be introduced for all EU countries.
The new regulations are to enter into force 14 days after their publication in the Journal of Laws.
