The Council of Ministers on Wednesday, November 18, 2024 adopted a package of draft
laws concerning foreigners. At the request of the Ministry of Development and
Technology, the extremely unfavorable and
criticized by
entrepreneurs provisions on mandatory hiring
foreigners on labor contracts were removed.
– The government’s decision to withdraw from mandatory hiring of foreigners on labor contracts is a step in the right direction, as it avoids inequality and unnecessary burden on entrepreneurs and foreigners. It should be remembered that freedom of contract is a key element of a well-functioning labor market – both Poles and foreigners should be able to choose the form of employment that best suits their needs and life situation. Introducing an obligation to employ only on employment contracts could paradoxically lead to a decrease in income stability in situations where other forms of cooperation, such as commission agreements or B2B contracts, are more flexible and meet the real needs of both employees and employers, comments Yuriy Grygorenko, chief analyst at Gremi Personal.
– We couldn’t have dreamed of a better Christmas present, we are positive about these changes,” comments Karolina Szleszyńska, Gremi Personal’s vice president for legal affairs. – We can still say that we are in favor of eliminating abuses and that inspections are needed, but it also can’t be the case that companies operating reliably according to the letter of the law due to formalisms have it uphill all the time. The unified text of the law is still not there, from the government it will still go to the parliament, but certainly today we can say that any move to simplify and shorten the process of hiring foreigners will be evaluated positively. We look forward to the full digitization of services and the sealing of the system.
