Earlier, the FAS Russia received a statement from the manufacturer of products under the brands Alpen Gold, Milka, Yubileinoye, Oreo, Barney Bear, Tuc, Dirol, Picnic. The company announced that its competitor had introduced Umka cookies into circulation. Its packaging design used elements that imitate trademarks of Oreo cookies (produced at the Bolshevik factory in the Vladimir region since 2015). The similarity consisted in the color design of the product name and packaging as a whole, the relative arrangement of elements and the imitation of the slogan.
According to the department, such actions may create a false impression among consumers about the product supplier and contribute to the misuse of the reputation of the copyright holder of the Oreo brand.
The Federal Antimonopoly Service of Russia opened a case against the manufacturer of Umka cookies for violating antimonopoly legislation. To consider it, a commission has been created that will check the activities of the entity for violations of the Law on Protection of Competition (Article 14.6 of the Federal Law “On Protection of Competition” dated July 26, 2006 No. 135-FZ).
