Russian President Vladimir Putin approved amendments to the law on state regulation of production and circulation of alcoholic and alcohol-containing products (dated 22.11.1995 No. 171-FZ ), which change the rules for licensing producers, sellers and importers of alcoholic and alcohol-containing products, writes buh.ru. The new regulations have reduced the time period for reviewing applications from applicants for licenses to carry out activities related to the production and circulation (except for retail sales) of ethyl alcohol, alcoholic and alcohol-containing products from 30 to 20 calendar days (with the possibility of extending the review period by no more than 10 working days). The reduced period will apply when submitting an application and documents through the EGAIS or the Unified Portal of State Services.
The law also reduces the list of documents required to obtain a license to carry out activities related to the production and distribution (except for retail sales) of ethyl alcohol, alcoholic and alcohol-containing products.
The list of documents required to obtain a license to carry out one of the activities related to the production of ethyl alcohol, alcoholic and alcohol-containing products will be reduced from 12 to 6. In addition to the application, the following will remain on this list:
- information about your own or contracted testing laboratory;
- a document confirming that the organization has paid-up authorized capital;
- calculation of the production capacity of the main technological equipment for the production of ethyl alcohol or alcoholic beverages;
- information on beneficial owners, controlling persons and management bodies;
- information about legal entities included in the same group and affiliated organizations.
To obtain a license for the production, storage and supply of produced wine (including sparkling wine) with a protected geographical indication or designation of origin, the number of documents submitted will be reduced from 11 to 3. In addition to the application, they will need to provide information about the testing laboratory and a calculation of the production capacity.
Peasant farms and individual entrepreneurs with the status of agricultural producers will only need to submit information about the testing laboratory and documents confirming the status of agricultural producer (for individual entrepreneurs) along with the application to obtain a license for the production, storage and supply of produced wine (including sparkling wine).
The amendments have reduced the list of types of documents submitted to obtain licenses for the retail sale of alcohol, as well as the transportation of alcohol and alcohol-containing products by road.
In addition, the amendments have relaxed the requirements for reissuing a license in the event of a change in the name of the licensee (without its reorganization), or a change in its location (if the checkpoint of its separate divisions does not change). Reissuance of a license will be carried out by the licensing authority automatically on the basis of information received within the framework of the interdepartmental electronic interaction system.
The new regulations will come into force in stages, starting from September 1, 2024.
