Since 2021, small and medium-sized entrepreneurs have filed 4,291 claims against the online marketplaces Ozon and Wildberries – this is 87.6% of all claims in arbitration courts filed against the two companies during their operation. In total, the file contains 4,895 claims against the two largest marketplaces filed before the end of 2023, Vedomosti writes, citing data from the file of arbitration cases (CAD).

As noted by the Chairman of the Russian Consumer Union, Petr Shelishch , the amount of claims against marketplaces is growing faster than their turnover. According to the CAD, Wildberries LLC was a defendant in 3,518 arbitration cases and 3,281 claims were filed from 2021 to 2023. In 2021, 271 claims were filed against the company, in 2022 – 717 (160% more), in 2023 – 2,293 (220% more). Internet Solutions LLC (the main legal entity of Ozon) has received 877 claims in arbitration courts over the entire period, it follows from the Ring Road. The last three years accounted for 669 of them: 109 claims in 2021, 165 in 2022 (+50%), 395 in 2023 (+140%).
The Ministry of Industry and Trade noted that over the past few years, the e-commerce market has shown rapid growth, which entails an increase in the number of cases of disputes between sellers or owners of pick-up points (POPs) and marketplace owners. According to Alexey Koitov, co-chairman of the Russian Consumer Union for Digital Sphere and International Relations , claims against marketplaces are filed in arbitration courts mainly by sellers and owners of pickup points, but logistics companies can also do this. The amounts of claims against marketplaces for these claims are small and amount to tens or hundreds of thousands of rubles. As Alexey Chernyshev, a senior lawyer in the dispute resolution practice of Kucher Kuleshov Maksimenko and Partners, noted, in its entire history Ozon had a little more than 10 cases with claims amounting to more than 10 million rubles, in which the company acted as a defendant, and Wildberries had about 100.
Last year, Wildberries’ turnover exceeded 2.5 trillion rubles, and Ozon’s turnover for the full year 2023 increased by 111% year-on-year and exceeded 1.75 trillion rubles.
