Especially since the answer to the question whether selling alcohol online in Poland is allowed is not simple. Pursuant to Art. 15 section 1 of the Act of 26 October 1982 on upbringing in sobriety and counteracting alcoholism, the sale of alcoholic beverages may only be made to persons who are over 18 years of age, and the sale of alcohol must be carried out on the basis of a permit issued for a specific sales point.
However, the judgment of the Supreme Administrative Court of September 8, 2022 (reference number II GSK 2034/18) changed the interpretation of the regulations, finding that the sale of alcohol online from a physical sales point for which a permit was issued is permissible. It is important that in the regulations of the online store, sales are formally conducted at a physical point of sale.
